Returns
1. Right of withdrawal (Consumers)
You have the right to withdraw from the contract, without giving any reason, within 14 days of receiving the goods, under articles 52–59 of the Italian Consumer Code (D.Lgs. 206/2005).
To exercise the right of withdrawal:
- Send a written notice to info@effettistore.it within 14 days of delivery, stating the order number, the items to be returned and your chosen refund option; alternatively, use the standard withdrawal form provided by the Consumer Code.
- Ship the goods back within 14 days of your withdrawal notice to: Effetti di Tritapepe Riccardo — Via Floraspe Renzetti 10, 66034 Lanciano (CH), Italy.
Returning the goods is entirely the Customer's responsibility, both in terms of costs and of arranging the shipment: the Customer organises the return shipping, chooses the carrier and bears the related direct costs (art. 57 Consumer Code), and remains responsible for the goods until they are received at Effetti's warehouse. We recommend a tracked shipment and adequate packaging: items lost or damaged during return transport remain the Customer's responsibility.
Goods must be returned in their original condition: intact, unworn, with all labels, tags and original boxes.
2. Refunds
Once the goods have been received and checked, we will refund the amount paid within 14 days of receiving your withdrawal notice; we may withhold the refund until we have received the goods back or you have supplied evidence of having sent them (art. 56.3 Consumer Code).
Original shipping costs (order delivery):
- if you withdraw from the entire order with a monetary refund, standard delivery charges you paid are also refunded (art. 56.1 Consumer Code); supplementary costs of any non-standard delivery method you chose are not refunded;
- in the case of a partial return (withdrawal on only some items of the order), a size/colour exchange (Option A) or a return voucher (Option B), the original shipping costs are not refunded: the refund or voucher covers only the value of the returned items.
Return shipping costs are in all cases borne by the Customer (see section 1). Refunds are issued via the same payment method used for the purchase (credit card: typically 5–15 business days depending on the issuing bank; PayPal: 1–3 business days).
3. Exclusions
Under art. 59 Consumer Code, the right of withdrawal does not apply to: custom-made or clearly personalised goods; sealed goods unsuitable for return for hygiene or health-protection reasons if unsealed after delivery (e.g. underwear, swimwear worn without hygienic protection); goods inseparably mixed with other items after delivery; gift cards and vouchers.
4. Alternative options (voluntary extension)
In addition to the legal right of withdrawal, within 14 days of delivery you may choose between:
- Option A — Exchange for a different size or colour of the same item, subject to availability (any price difference is charged or credited);
- Option B — Return voucher equal to the value of the returned item(s), valid on effettistore.it for 90 days from issue, single-use, not combinable with other promotions, not convertible into cash;
- Option C — Monetary refund via the original payment method (see section 2).
Options A and B are an additional service and never limit the legal right of withdrawal (Option C), which always remains available.
5. Condition of returned items
To be accepted, returned items must be: in the same condition as delivered; with all labels, tags, seals, original boxes and accessories; unwashed, unworn (beyond what is compatible with the right of withdrawal), undamaged; accompanied by a copy of the receipt or order confirmation. We reserve the right to refuse non-compliant returns or to apply a value reduction proportional to the diminished value of the goods (art. 57.2 Consumer Code), giving reasons to the Customer.
6. Defective or non-conforming products
If an item is defective, non-conforming or wrong, contact info@effettistore.it within 14 days of discovering the defect, attaching photos and a description. Under the legal guarantee of conformity (24 months, art. 128 ff. Consumer Code) we will arrange: repair or replacement at no cost to you; or a price reduction or contract termination where repair/replacement is impossible or excessively onerous; with refund of the price paid including return shipping costs in these cases.
